Terms & Conditions
These terms and conditions apply to all orders submitted to the www.michaelngvyen.com webshop (referred to as “the webshop”), covering all purchase agreements that a consumer enters into online with Michael Nguyen-Faber, (referred to as “us” or “Michael Nguyen-Faber”). We encourage our buyers (referred to as “you” or “the customer”) to read these terms and conditions in their entirety before using the webshop or submitting an order. These terms and conditions may be updated and vary from time to time. Please check them previous to every order you place in the webshop.

2. THE CONCLUSION OF CONTRACT
The presentation of the products does not constitute a binding contract offer. To place an order, you must follow the online shopping process of adding the desired goods to your virtual shopping cart and following the shopping process on the checkout page. You have the chance to review your order and then click “complete order” to be directed to your chosen payment method.
By completing this step, the customer submits a legally binding offer of contract with regard to the goods contained in the shopping cart.
When your offer to buy from us is received, you get an automatic acknowledgement of receipt (“order confirmation email”) to the email address you submitted. Please note that this does not mean that your order has been accepted, it merely documents that your order has been received.
A binding purchase agreement is entered into as soon as your order has been accepted by Michael Nguyen-Faber and a shipping confirmation email has been sent to the email address you submitted.
Contract languages are German and English.
3. PRICES & INVENTORY
Occasionally there may be information in the Webshop that contains errors or inaccuracies, relating to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors or inaccuracies, to update information or cancel orders if any information in the Webshop is inaccurate at any time without prior notice (including after you have submitted your order).
Michael Nguyen-Faber reserves the right to cancel a purchase agreement if fraud is suspected.
The prices in our Webshop constitute the total price (including sales tax and delivery costs).
If you have further questions regarding customs fees, please contact your local customs office.
4. DISCOUNTS
We reserve the right to change prices and discount items from time to time without prior notice. Discount codes are only valid once per person (unless otherwise stated) and only within the stated period of time. They may not be combined or transferred to another purchase.
From time to time, we may offer bundles of products at a discount. If you purchase two items that are part of a bundle deal, you may receive a bundle discount on one or more of those items. If you return only the non-discounted bundle item, the discount on the discounted bundle item you decide to keep becomes invalid. In this case, you will be refunded only the amount up to the regular cost of the item you keep.
5. PAYMENT
Payment is currently only possible in the currency set out in the Webshop, which is Euro (€). Customers can pay with all major credit cards and other popular payment methods.
Payment is due immediately after conclusion of the contract, unless the parties have arranged a later date. If payment is pending, Michael Nguyen-Faber reserves the right to halt the shipment until full amount has been received. A purchase may be declined if payment did not go through or fraud is detected.
6. CONTRACTUAL OBJECT
The nature of the ordered goods results from the product descriptions in the online shop. Images on the website may reflect the products inaccurately; especially for technical reasons Images are for illustrative purposes only and may differ from the product. Descriptions of specifications, weight, measures and performance are as precise as possible, but may have the usual deviations.
7. SHIPPING & DELIVERY
All orders are shipped from Berlin. Once shipped, you will receive a shipping confirmation email, including a tracking link.
If you haven't received a shipping confirmation please check your spam folder first.
Shipping time will vary depending on your location.
If a purchase sent to you is returned as undeliverable, we reserve the right to charge you a fee covering the cost of the shipping.
Should your order be delayed you will receive a notification via email. You may cancel the order and get a full refund if you do not accept the new suggested time of delivery.
All dispatched items are insured by Michael Nguyen-Faber up to a certain amount. Should you discover any damage to the package prior to opening it, please take a photo and report this to us at michaelngvyenfaber@gmail.com as soon as possible.
8. RETURNS & EXCHANGES
We currently do not offer exchanges. If you want to exchange for another size or print, please place a new order.
9. DAMAGED PRODUCTS
Michael Nguyen-Faber ensures that all products go through several quality control procedures before being dispatched to our customers. We work hard to avoid damages or defects in our products. Should you receive a damaged item, please send us an email including a photo of the defect within 14 days from the time of delivery.
10. RIGHT OF WITHDRAWAL
As a consumer, you have the right to revoke a contract within fourteen days without giving reasons. However, the right of revocation and return is excluded for goods that are manufactured on demand.
Buyers of a print can cancel the order free of charge until the purchase amount is transferred, since the individual production has not yet begun. On the day of the transfer of the purchase amount, the production of the individually configured photo work begins. From this point on, the order can no longer be revoked.
In order to exercise your right of withdrawal, you must inform us via email: michaelngvyenfaber@gmail.com by means of a clear statement of your decision to withdraw from this contract.
11. COLORS
Although all measures have been taken to ensure color accuracy, please note that there may be slight color deviations between the device on which you are viewing this website and the actual physical printing itself. These technical deviations do not give rise to a claim for warranty (liability for defects).
12. OWNERSHIP
Until full payment, the delivered goods remain the property of the seller.
13. FINAL PROVISIONS
Should any provision of these Terms and Conditions be ineffective, this shall not affect the remaining provisions. In place of the invalid provision, the relevant statutory provisions apply.
German law applies.
The place of fulfillment and jurisdiction is, as far as legally permissible, for deliveries and payments as well as all disputes arising between the parties, Germany. For end-consumers, the place of performance and jurisdiction is the buyer's place of business.
